Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Forsure.ai ("Forsure," "we," "our," or "us"). Forsure is a next-generation healthcare and insurance platform that uses artificial intelligence, automation, and human-in-the-loop support to deliver personalized, proactive guidance through our AI agents, Alex and Ollie (collectively, the "Services"). These Terms govern your access to and use of the Services, including our website, mobile applications, and all related features and functionality.
By accessing or using any part of the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
If you access the Services through an agreement between Forsure and your employer, plan sponsor, or another organization (an "Enterprise Agreement"), that Enterprise Agreement governs in the event of a conflict with these Terms, and these Terms apply to your individual use of the Services to the extent not addressed by the Enterprise Agreement.
1. ACCEPTANCE OF THESE TERMS
By creating an account, accessing, or using the Services, including our website or mobile app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy and Security Statement available at www.forsure.ai/privacy (the "Privacy Statement"). If you do not agree, you must discontinue use of the Services immediately. Your continued use of the Services following any modifications to these Terms constitutes your acceptance of such modifications.
2. DEFINED TERMS; INCORPORATION BY REFERENCE
Capitalized terms used but not defined in these Terms have the meanings given in the Privacy Statement. The Privacy Statement describes Forsure's practices regarding the collection, use, storage, and sharing of your personal information, including information collected through cookies, tracking technologies, and communications. The Privacy Statement is incorporated into and forms part of these Terms. These Terms govern your relationship with Forsure generally; in the event of a conflict between these Terms and the Privacy Statement concerning the collection, use, or protection of personal information, the Privacy Statement will control.
3. Role of Alex & Ollie (AI Agents)
Alex and Ollie are Forsure's intelligent assistants who work behind the scenes and directly with users to deliver smarter healthcare and insurance navigation.
- Ollie is your AI-powered personal healthcare assistant. Ollie helps individuals understand insurance benefits, find providers, schedule care, explain confusing healthcare terms, and follow up to ensure your needs are met.
- Alex is designed to support plan administrators, HR professionals, and benefits teams. Alex provides real-time assistance with benefit and eligibility questions, change reporting for employee status or plan selection, analytics dashboards, insights, and automated reporting, help navigating billing, enrollment, and communications, and seamless coordination between your organization and Forsure.
Alex and Ollie are AI assistants operated by Forsure. They are not licensed medical, insurance, legal, or financial professionals and do not provide medical care, diagnosis, or treatment. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Do not delay seeking care based on information provided by the Services.
To operate Alex and Ollie, Forsure relies on third-party cloud and AI infrastructure. For a full description of how your data is collected, used, and shared in connection with the Services, including the third-party providers we use, please refer to the Privacy Statement.
Forsure may modify, suspend, or discontinue any feature of the Services at any time. We will use reasonable efforts to notify you of material changes that affect your use of the Services.
4. User Eligibility
The Services are intended for users who are at least 18 years of age and reside in the United States. By accessing or using the Services, you represent and warrant that you meet these eligibility requirements. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and the term "you" shall refer to both you individually and the organization you represent.
If you use the Services to manage benefits or care for your dependents or other household members, you represent that you are authorized to provide their information to Forsure and to act on their behalf, and you agree that these Terms and the Privacy Statement apply to that information.
5. ACCOUNT RESPONSIBILITIES
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to:
(a) provide accurate, current, and complete information during registration and in your use of the Services;
(b) promptly update your account information as necessary;
(c) notify Forsure immediately of any unauthorized use of your account or any other breach of security;
(d) not share your account credentials with any third party.
Forsure may require multi-factor authentication, including one-time codes sent by text message or email, to protect your account. Forsure is not liable for any loss or damage arising from your failure to comply with this Section.
6. Payments & Financial Information
We use Stripe to securely process payments. We do not store your full payment card information on our servers. Stripe's systems process transaction data using industry-standard encryption in transit and at rest. By providing payment information, you represent and warrant that you are authorized to use the designated payment method. 7. INTELLECTUAL PROPERTY
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, trademarks, software, algorithms, and the design, selection, and arrangement thereof, are the exclusive property of Forsure or its licensors and are protected by United States and international intellectual property laws. Forsure, SureSystem, SureConsult, Alex, and Ollie are trademarks of Forsure. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes, subject to these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works based on any part of the Services without Forsure's prior written consent.
You retain ownership of the information and content you submit to the Services ("User Content"). You grant Forsure a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and process User Content solely as necessary to provide, maintain, secure, and improve the Services, consistent with the Privacy Statement and any applicable Enterprise Agreement.
If you provide suggestions, ideas, or feedback about the Services ("Feedback"), you grant Forsure a perpetual, irrevocable, royalty-free license to use the Feedback for any purpose without obligation to you.
8. ACCEPTABLE USE
You agree not to, and not to attempt to:
(a) use the Services for any unlawful purpose or in violation of any applicable law or regulation;
(b) access, collect, or attempt to access information about any other person without authorization;
(c) use automated means, including bots, scrapers, or bulk querying, to access the Services or extract data;
(d) attempt to extract, reverse engineer, or interfere with the AI models, system prompts, or underlying software that power Alex and Ollie;
(e) upload or transmit malware or any code designed to disrupt or damage the Services;
(f) impersonate any person or entity or misrepresent your affiliation;
(g) use the Services to harass, threaten, defraud, or harm any person;
(h) circumvent security or access controls; or (i) resell, sublicense, or provide the Services to third parties except as permitted by an Enterprise Agreement.
9. AI AGENT USE POLICY
Forsure utilizes artificial intelligence and automated systems, including its AI agents Alex and Ollie, to deliver, maintain, and improve the Services. By using the Services, you acknowledge and agree that: (a) AI-generated content, suggestions, or guidance are provided for informational purposes only and do not constitute professional medical, legal, insurance, or financial advice; (b) AI-generated content may contain errors or omissions, and you should verify important information, including coverage, cost, and eligibility details, against your plan documents and with your insurance carrier or plan administrator; (c) you are solely responsible for any decisions made based on information provided by the AI agents; and (d) Forsure may employ automated safety systems to monitor account activity and usage patterns for potential violations of these Terms or applicable law, and may take appropriate action, including issuing warnings, restricting access, or terminating accounts. Human Forsure personnel may review interactions with Alex and Ollie to provide support, ensure quality, and investigate flagged activity. The collection and use of your information in connection with the AI agents is described in the Privacy Statement.
10. U.S. JURISDICTION
Forsure is built for users in the United States. By using the Services, you consent to having your information processed in the U.S. under applicable U.S. laws, which may differ from those in your home country. For more information about data storage and processing, see the Privacy Statement.
11. SMS TEXT MESSAGING TERMS & CONDITIONS
Forsure provides SMS text messaging to help you stay informed with important account or platform related topics that need your attention. Message types include: login verification codes (2FA), account activity alerts, appointment reminders, and billing or statement notifications. Message frequency varies and standard message and data rates may apply. You consent to receive these messages through our onboarding steps by opting in and providing your mobile device number. You may opt out at any time by replying STOP to any SMS text message you receive from Forsure. Reply HELP for help. For support, contact compliance@forsure.ai.
SMS messages are sent by Forsure to provide customer communications. We do not share or sell mobile opt-in data or phone numbers to third parties or affiliates for marketing purposes. Carriers are not liable for delayed or undelivered messages. View our Privacy Statement at www.forsure.ai/privacy.
12. DISCLAIMERS AND LIMITATION OF LIABILITY
THE SERVICES, INCLUDING ALL CONTENT AND GUIDANCE PROVIDED BY ALEX AND OLLIE, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FORSURE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE. THE SERVICES DO NOT CONSTITUTE MEDICAL, LEGAL, INSURANCE, OR FINANCIAL ADVICE, AND YOU SHOULD CONSULT QUALIFIED PROFESSIONALS BEFORE MAKING ANY HEALTHCARE OR INSURANCE DECISIONS. FORSURE DOES NOT GUARANTEE THE AVAILABILITY OF ANY HEALTHCARE PROVIDER, THE OUTCOME OF ANY APPOINTMENT, OR ANY COVERAGE, ELIGIBILITY, OR CLAIM DETERMINATION, WHICH ARE MADE SOLELY BY YOUR PLAN, INSURER, OR PROVIDER.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FORSURE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY. FORSURE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO FORSURE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Forsure, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
(a) your misuse of the Services or use of the Services in violation of these Terms;
(b) your violation of any applicable law or regulation;
(c) your violation of the rights of any third party;
or (d) any User Content you provide through the Services.
14. TERMINATION
Forsure may suspend or terminate your access to the Services at any time, with or without cause, and will provide notice where practicable. Upon termination, your right to use the Services will immediately cease. You may terminate your account at any time through the account settings in the app or by contacting Forsure at compliance@forsure.ai. Information about how we handle your personal information after termination, including account deletion and data retention, is described in the Privacy Statement. All provisions of these Terms that by their nature should survive termination shall survive, including without limitation intellectual property provisions, disclaimers, limitations of liability, indemnification, and governing law.
15. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of such courts. Before filing a claim, you agree to first contact Forsure at compliance@forsure.ai and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
16. GENERAL PROVISIONS
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the parties.
Entire Agreement. These Terms, together with the Privacy Statement and any applicable Enterprise Agreement, constitute the entire agreement between you and Forsure regarding the Services and supersede any prior agreements or understandings.
Assignment. You may not assign or transfer these Terms or your account without Forsure's prior written consent. Forsure may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
No Waiver. Forsure's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or of the right to enforce it later.
Force Majeure. Forsure shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including natural disasters, acts of government, labor disputes, internet or utility failures, or failures of third-party providers.
Electronic Communications. You consent to receive communications from Forsure electronically, including by email, text message, in-app notification, or posting on the website, and you agree that such electronic communications satisfy any legal requirement that communications be in writing.
Notices. Notices to Forsure must be sent to compliance@forsure.ai or to the mailing address in the Contact Us section below.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time as our platform evolves. We will notify you of material changes via email, in-app message, or through the website. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms. The latest version of these Terms will always be available at www.forsure.ai/terms-service].
Please review them periodically.
18. RESPONSIBLE DISCLOSURE AND BUG BOUNTY PROGRAM
Forsure maintains a Responsible Disclosure and Bug Bounty Program to promote platform security. If you identify a potential vulnerability, please report it promptly to compliance@forsure.ai]with sufficient detail to reproduce the issue. Reports are limited to Forsure-owned domains and applications.
In conducting security research, you must not: access, modify, or exfiltrate data belonging to Forsure or any user, including protected health information; degrade or disrupt the Services (including denial-of-service testing); use social engineering, phishing, or physical attacks; or publicly disclose a vulnerability before Forsure has had a reasonable opportunity to remediate it. Forsure will not pursue legal action against researchers who act in good faith and within these rules.
All submissions are subject to verification and validation. Once confirmed, the first eligible report of a unique, previously unknown vulnerability will receive a reward of $100, at Forsure's sole discretion. Duplicate reports, out-of-scope findings, and issues without demonstrated security impact are not eligible.
